Terms of Service

1. Acceptance of Terms
By using Obskura’s automatic DVR service for livestreams (the “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you must discontinue use of the Service.
2. Age Requirement
The Service is intended for users 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use the Service.
3. Service Description
Obskura monitors creators you select and automatically records their livestreams from supported platforms (e.g., Twitch, YouTube, TikTok, Kick, and others) when they go live. The list of supported platforms may change at any time due to technical, legal, or policy reasons. Certain features may be offered as beta/experimental and may be less stable.
4. User Responsibilities
- You are solely responsible for ensuring your use of the Service complies with all applicable laws and the terms of the source platforms, including any restrictions on recording, storing, redistributing, or commercial use of content.
- If you intend to use recordings commercially, you must obtain all necessary rights, licenses, and permissions. Obskura does not grant you any rights to third-party content.
- You must not use the Service to infringe intellectual property, violate privacy rights, or otherwise harm others.
- You are responsible for your device’s storage, backups, and security of recorded files.
5. Privacy and Data
Obskura is designed with privacy in mind:
- Recordings: All recordings are stored locally on your device. Obskura does not access, view, or transmit your recorded files.
- Authentication: Login is handled by third-party providers (Google and Discord). Obskura does not store or manage your passwords.
- User Profile Data: We store limited account details (e.g., email and linked account identifiers) to create and maintain your user profile and enable app functionality.
- Payments: Payments and subscriptions are processed by Stripe. We do not store card details. We may store subscription status, plan, invoices, and payment confirmations to provide your access and billing history.
- Diagnostics & Usage: We may collect non-identifiable diagnostics (e.g., error logs, performance metrics) to improve reliability and support.

6. Service Availability
We strive for reliability but do not guarantee uninterrupted availability or successful recording of all streams. Availability may be affected by platform changes, creator settings (e.g., region locks or private streams), network issues, or maintenance. Features may be modified, suspended, or discontinued at any time.
7. Billing, Subscriptions, and Refunds
Subscriptions are managed through Stripe and renew automatically until canceled. You can cancel at any time from the Manage Subscription page in your account settings; access continues through the end of the current billing period. Taxes may apply. Certain support channels and features may require an active subscription.
Refunds are issued on a prorated basis for the unused days remaining in the current billing month. You can request a refund at any time by visiting the Manage Subscription page in your account settings, or by opening a ticket in our Discord community. Refunds are returned to the original payment method and typically appear within 5–10 business days, depending on your bank or card issuer.
8. Intellectual Property
Third-party content recorded via the Service remains the property of its respective creators/owners. Obskura does not claim any ownership of such content. You may not remove or alter any rights notices.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. OBSKURA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE SUCCESSFUL RECORDING OF ANY PARTICULAR STREAM OR CONTENT.
10. Limitation of Liability
To the maximum extent permitted by law, Obskura will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, recordings, profits, or business opportunities, arising from or related to your use of the Service.
11. Indemnification
You agree to indemnify and hold harmless Obskura and its affiliates, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.
12. Account Suspension & Termination
We may suspend or terminate access for violations of these Terms, suspected fraud/abuse, or to comply with law or platform policies. Termination may result in loss of access without refund.
13. Referral Program
Obskura offers an optional referral program. By participating, you agree to the following terms in addition to the rest of these Terms.
- Eligibility: Any registered account may share a referral link. Requesting a payout requires a verified email address. One referrer per referred customer, determined by the first referral link used at signup.
- Referred customer offer: Users who sign up through a referral link receive 15% off their subscription invoices for their first 3 months. The discount applies to a user's first subscription only, and cannot be combined with promotional codes.
- Rewards: Referrers earn $1.00 USD for each paid monthly billing cycle of a referred customer. Rewards begin once the referred customer completes their second paid billing cycle, at which point the first two months are credited together, and continue for each subsequent paid cycle while the referred customer remains subscribed. We may offer modified reward rates to selected participants at our discretion; all other terms of this section continue to apply.
- Voided rewards: If a referred customer's payment is refunded, disputed, or charged back, the referral is voided: future rewards stop and unpaid reward balances attributable to that customer are reversed.
- Prohibited conduct: Self-referrals, referrals between accounts under common control, use of stolen or unauthorized payment methods, and any manipulation of the program are prohibited and may result in forfeiture of the entire reward balance and account termination.
- Payouts: Reward balances may be redeemed as subscription credit (from $1.00) or paid out in cash (from $15.00) via our payment processor, Stripe. One payout request may be open at a time. Payouts are reviewed before being sent, and we may request identity or tax documentation (e.g., IRS Form W-9 or Puerto Rico equivalents) where required by law. Bank transfer delivery times depend on your bank and country and are not guaranteed.
- Taxes: You are responsible for any taxes on referral earnings. We may report payments to tax authorities where legally required.
- No cash value: Reward balances are not property, have no cash value until paid out, and may not be sold, transferred, or exchanged.
- Program changes: We may modify, suspend, or terminate the referral program at any time. Changes apply prospectively and do not affect rewards already earned in accordance with these terms.
14. Governing Law
These Terms are governed by the laws of Puerto Rico and the United States, without regard to conflict-of-law principles. Venue and jurisdiction will lie in the competent courts located in Puerto Rico.
15. Changes to Terms
We may update these Terms at any time. If changes are material, we will provide notice by reasonable means. Your continued use of the Service after changes take effect constitutes acceptance.
